Brady Toensing

Of Counsel

Toensing obtained his undergraduate and law degrees from Georgetown University. Prior to and during law school, he served as a Special and Legislative Assistant to United States Senator Warren B. Rudman. He has been practicing law for more than 25 years and has represented companies, individuals, and other entities in a wide range of complex civil and criminal matters, including administrative, judicial, and federal agency proceedings.

Congressional Investigations. Toensing has represented clients in numerous Congressional investigations, including Ruby Ridge, Waco, the Clinton Pardon Probe, the Senate Permanent Subcommittee on Investigations inquiry into Tax Shelters, and the House Committee on Oversight and Reform’s Firearms Industry inquiry.

Federal Investigations. Toensing has represented clients in federal grand jury investigations involving domestic and international matters, including the Foreign Corrupt Practices Act (FCPA), the Office of Foreign Assets Control (OFAC), the International Traffic in Arms Regulations (ITAR), money-laundering, banking, government procurement, unions, healthcare, witness tampering, campaign finance, false statements, wire and mail fraud, and obstruction of justice.

Internal Investigations and Compliance. Toensing has conducted internal investigations and prepared reports and compliance programs for national and international corporations and labor unions. In carrying out these tasks, he coordinated the activities of other attorneys, former-FBI agents, and forensic auditors. He also served as Chief Investigative Counsel for the International Brotherhood of Teamster’s Independent Investigations Officer.

First Amendment and Political. Toensing litigated and won a landmark First Amendment case in the Vermont Supreme Court that expanded access to government records stored in private accounts under the state’s open records law. He was thrice elected Vice Chairman of the Vermont Republican Party. He served as General Counsel to Vermont Lieutenant Governor Brian Dubie’s reelection campaign and as litigation counsel to his campaign for Governor. He was lead election-day counsel for the Vermont Republican Party through numerous election cycles. He was also Vermont Chair and lead election-day counsel in Vermont for the 2016 Trump Presidential Campaign.

Second Amendment Rights. Toensing has represented individuals, businesses, and sportsmen’s groups in defense of Second Amendment Rights, including a pending federal case challenging Vermont’s magazine ban and firearm purchase waiting period. He recently represented a major firearm manufacturer during the U.S. House of Representatives’ Committee on Oversight and Reform’s efforts to develop legislation banning AR-15 rifles. Toensing has also represented numerous firearm manufacturers regarding ATF investigations and compliance with domestic and international firearm regulations. He successfully lobbied the Vermont legislature for repeal of a state suppressor law to the benefit of both hunters and manufacturers.

The United States Department of Justice. Toensing worked for the Department of Justice as a Senior Counsel in the Office of Legal Policy from June 2019 until January 2021. He helped lead and coordinate the Department’s efforts to reform Section 230 of Communications Decency Act of 1996 (47 USC § 230), which provides immunity from civil liability to online platforms. He also assisted with the confirmation of Amy Coney Barrett as an Associate Justice of the United States Supreme Court, serving as a member of the Rapid Response Team.
